1.0 TITLE, DATE AND PERIOD OF OPERATION
1.1 This Agreement is called the SBS Enterprise Agreement 2022/23.
1.2 This Agreement will commence seven days after approval by the FWC, and will expire on 6 February 2026.
2.0 READING THIS AGREEMENT
2.1 In this Agreement, a number of terms have specific meanings. The meanings of these terms, and other information about how this Agreement is read and interpreted, are found in Schedule F.
3.0 COVERAGE
3.1. Subject to clause 3.2, this Agreement covers:
(a) SBS;
(b) Employees, other than as set out in clause 3.2; and
(c) each employee organisation which the FWC notes is covered by the Agreement under section 201(2) of the FW Act.
3.2. This Agreement does not cover:
(a) persons who are not covered by a classification in Schedule A of this Agreement; or
(b) the Senior Leadership Group.
3.3 For Employees classified at Level 7 under Schedule A of this Agreement, and other Employees paid at least the full time equivalent Level 7 minimum salary rate, the following provisions of the Agreement will not apply:
(a) Part 3 (Public Holidays, other than clause 8);
(b) Part 5 (Pay and Allowances), other than:
(i) clause 25 (Salaries); and
(ii) clause 30 (Salary Packaging);
(c) Part 6 (Hours of Work), other than: (i) clause 34 (Full-time Employees); and
(ii) clause 35 (Part-Time Employees).
(d) Schedule C – Reward for Performance.
4.0 RELATIONSHIP TO THE AWARD AND THE NES
4.1. This Agreement rescinds and replaces all other collective agreements between the persons whom it covers, whether or not such agreements were approved by the FWC or otherwise registered or certified, including the SBS Enterprise Agreement 2019.
4.2. This Agreement will apply to the exclusion of the Award, or any other award which may cover SBS or an Employee from time to time.
4.3. No term of this Agreement will operate to exclude the NES or reduce any provision of the NES. 5.
5.0 EMPLOYER AND EMPLOYEE DUTIES
5.1. SBS may direct an Employee to carry out duties within the Employee’s skill, competence and training, consistent with the classification structure of this Agreement, provided that such duties are not designed to promote deskilling.
5.2. Any direction issued by SBS under this clause is to be consistent with SBS’s responsibilities to provide a safe and healthy working environment.
