55. HOME-BASED WORK
55.1. The parties recognise that home-based work can provide flexibility for Employees in balancing their work and personal responsibilities while meeting business needs
55.2. An Employee and SBS may agree that the Employee will perform home-based work which may be on a short term, temporary or long term basis.
55.3. The particulars of any agreed home-based working arrangements will be dependent on the circumstances of the employee, the nature of the role the Employee performs and the needs of SBS.
55.4. The making of an agreement to perform home-based work is subject to:
(a) the suitability of the home environment to the duties which the Employee performs (including their ability to perform those duties safely); and
(b) any relevant policy or procedure of SBS in relation to home-based work, which is not part of or enforceable under this Agreement, and may be varied by SBS at its discretion.
55.5. SBS will determine whether or not home-based work is approved, and SBS and the Employee will agree which days are to be worked at home.
55.6. The Employee and SBS will confirm the home-based working arrangements in writing.
55.7. An agreement for home-based work may be terminated by either party giving 2 weeks’ written notice, or immediately by SBS if based on concerns as to the safety of the Employee.
55.8. Notwithstanding any other provision of this clause, SBS may require that an Employee perform home-based work where this is practicable in response to a public health or other emergency, whether declared by a government authority or not.
