57. PAYMENT RECOVERY OF SALARY AND WAGES
57.1. Under Payments
57.1.1 In the event of underpayment of salary or allowances to an Employee under this Agreement, the underpayment will be corrected in full as soon as practicable.
57.1.2 Where SBS and an Employee who alleges underpayment are unable to reach agreement on the extent of the underpayment and/or the time frame for repayment the matter will be dealt with under clause 52.
57.2. Recovery of overpayments
57.2.1 Where an overpayment of salary or an allowance has occurred, identified by the Employee or SBS, the overpayment will be recovered in accordance with this subclause. The recovery of overpayments to Employees will be done in accordance with the requirements of the FW Act.
57.2.2 The process for the recovery of overpayments to Employees will be as follows:
(a) On becoming aware of a salary overpayment to an Employee, SBS will notify the Employee in writing and establish an agreed period with the Employee to deduct the amount in lump sum or in instalments from the next available pay(s).
(b) Where an Employee is notified of an overpayment under clause 57.2.2(a) and seeks to dispute the amount of the debt, the Employee will immediately bring this to SBS’s attention and then follow up in writing within seven calendar days. In this event, SBS will not take further action until the dispute is settled.
(c) An Employee may authorise SBS to deduct from their final pay, including any leave entitlements, on cessation of employment for any overpayment balance remaining outstanding.
