32.2. Higher Duties Allowances
32.2.1 SBS may require an Employee to temporarily perform the work of a position classified at a salary level higher than their own position. A higher duties allowance is payable where an Employee is required, for a period of at least one full day, to perform all or a part of the work associated with a higher-level position, as follows:
(a) if they are required to perform all of the work associated with the higher position – an allowance equal to the difference between their own salary and the minimum salary for the higher salary level; or
(b) if they are required to perform only part of the work of the higher position – an alternative amount of allowance determined by SBS.
32.2.2 An Employee will continue to receive a higher duties allowance if they take paid leave during the period that they are receiving an allowance. This will not cause a higher duties allowance to be paid beyond the date that the Employee would have ceased performing higher duties had they been attending work.
32.2.3 Employees who are required to work in a classification with a minimum full-time salary at or above the Overtime Barrier for a period of less than 1 week will not be paid a higher duties allowance. The period will not count as service at the higher classification unless SBS determines otherwise.
32.2.4 Where an Employee receives a higher duties allowance for working in a single position for a continuous period of 12 months, SBS will review the situation to establish whether a vacancy exists. If a vacancy exists, a merit-based selection process will occur.
32.3. On-Call Arrangements
32.3.1 Where reasonable having regard to the nature of the Employee’s job, SBS may require an Employee to act as an On-Call Employee. Any introduction of on-call arrangements for Employees not currently required to work on-call will be subject to consultation with the Work Area as a whole and the individual Employee(s), with consideration of an Employee’s reasonable personal needs such as family or carer’s responsibilities.
32.3.2 On-Call Employees who are directed in writing (including by being rostered to be on call) or required by SBS to be on-call will receive an allowance for each hour or part thereof that they are on call, as follows:
|
When Employee is on call |
Hourly allowance |
|
Monday to Friday |
7.5% |
|
Saturday and Sunday |
10% |
|
Public Holiday or accrued day off |
15% |
32.3.3 Employees whose full-time equivalent salary is at or above the Overtime Barrier will not be eligible to receive payment of an on-call allowance except with the approval of SBS at its discretion.
32.3.4 For the purpose of calculating an on-call allowance, any higher duties allowance is included.
32.3.5 An on-call allowance is not payable for any period in respect of which an Employee is paid overtime.
32.3.6 An on-call allowance will not be payable to an Employee who does not remain contactable and at the required degree of readiness to perform work as required.
32.3.7 SBS may at its discretion determine an alternative, higher rate of the allowance payable to On-Call Employees, having regard to the circumstances and the degree to which the way they spend their time is restricted whilst on call.
32.3.8 On-Call Employees who are required to perform work (but are not recalled to work) will be paid overtime for the time worked, subject to a one hour minimum payment for the total work performed during each On-Call Period. The minimum payment in this clause will not apply where clause 32.3.9 applies.
32.3.9 On-Call Employees who are required to return to the workplace and perform work will be paid overtime for the time worked, subject to a three-hour minimum payment for the total work performed during each On-Call Period.
