38. FLEXTIME
38.1. Application
Flextime is not available to Employees who:
(a) work part-time hours;
(b) are required to work according to a shift roster;
(c) work an average 38 hour week and receive a rostered day off in a regular cycle; or
(d) are paid a salary above the Overtime Barrier.
38.2. Operation
38.2.1 Employees may vary their start and finish times and the period they work each day provided:
(a) start and finish times, including meal breaks, are agreed with their Manager and are between 7:00 am and 7:00 pm with a maximum 11 hour day;
(b) attendance will be monitored over two week cycles;
(c) over a cycle Employees may accumulate a maximum of two days flex credit and carry this over into the next cycle;
(d) over a cycle Employees may accumulate a maximum of two days flex debit and carry this over into the next cycle. Employees who accumulate more than 2 days flex debit at the end of a cycle will have the excess hours treated as leave without pay; and
(e) Employees with accumulated flex credit may take a flex day with the agreement of their Manager.
38.3. Reversion to standard hours
SBS may direct Employees to revert to standard hours for a period or otherwise temporarily vary the flextime arrangements, because of essential work requirements or because an Employee or group of Employees have failed to comply with the provisions of flextime.
38.4. Local Agreements
SBS and the majority of affected Employees may enter into local agreements on the operation of flextime in relation to the cycle, the debit and carry over, start and finish times, the hours in a standard day and the extension of flextime to staff otherwise excluded by the provisions of clause 38.1.
