40. RATES OF SHIFT PENALTY PAYMENTS
40.1. Subject to clause 40.2, Shiftworkers other than those to whom clause 40.2 applies, will receive shift penalties in accordance with the following table:

15% additional to base salary for the whole shift |

Ordinary duty where, for at least four weeks, an Employee exclusively works shifts falling wholly within the hours of 6:00 pm and 6:30 am. |
30% additional to base salary for each shift which falls between Monday – Friday during that period. |
40.2. Shiftworkers who are Journalists employed in News & Current Affairs and NITV, will receive shift penalty payments in accordance with the following table:

40.3. The above penalties in this clause are not cumulative. An Employee is entitled to only the highest penalty which applies to any given work.
40.4. Where an Employee is receiving a Higher Duties Allowance under this Agreement, that allowance will be treated as part of base salary for the purposes of the penalties in this clause.
