43. COMPOSITE PAY LOADING
43.1. Use of Composite Pay
43.1.1 SBS may pay all Employees in a Work Area a composite pay loading instead of shift penalties under this Agreement (other than penalties for working on an SBS Holiday). The amount of the loading will not be less than the Employee would have otherwise been paid under this Agreement. Composite pay does not apply to Employees classified at Level 5 to 7.
43.1.2 Composite pay loadings will continue to be paid during annual leave, but not during any other kind of leave.
43.1.3 A composite pay loading does not compensate Employees for working overtime, or for allowances to which they may be entitled. These entitlements will continue to be paid under this Agreement (subject to any buy-out loading).
43.1.4 New composite pay arrangements will only be adopted by agreement between SBS and a majority of the Employees in a Work Area.
43.1.5 Composite pay arrangements which were in force as of the making of this Agreement will continue unless varied or terminated.
43.2. Calculation of Composite Pay Loading
43.2.1 A composite pay loading for a Work Area will be calculated by:
(a) estimating the aggregate penalty rate (excluding public holidays) payable to Ongoing Employees in the Work Area, on the basis of projected rosters for the next 12 months; and
(b) only for Employees who have been continuously employed by SBS since before 27 June 1996, adding a loading in lieu of public holidays as set out below.
43.2.2 The aggregate penalty rate for a 12 month period is calculated by adding together the penalty rate for each shift in the projected roster as set out in the table below, and dividing the figure by the total number of shifts over the projected roster.

43.2.3 If an Employee who has been continuously employed by SBS since before 27 June 1996 who was previously rostered to work on public holidays, and they are required to work on more than 3 public holidays (other than the SBS Holidays), they will be paid a 50% loading for work performed on such additional public holiday(s).
43.2.4 For Employees who have been continuously employed by SBS since before 27 June 1996, the composite pay loading will include an amount of 1.73% instead of any penalty payments payable for working on public holidays other than SBS Holidays.
43.3. Rosters and Adjustment Mechanisms
43.3.1 SBS will determine roster patterns in accordance with operational needs. In so doing it will aim to spread unsociable rosters equally across a Work Area.
43.3.2 SBS will adjust composite pay loadings annually in accordance with projected rosters and the formula listed above. The rates may be adjusted up or down.
43.3.3 SBS may change composite pay loadings at other times, or discontinue composite pay arrangements, if operational needs require changes to roster patterns or in its view composite pay arrangements are no longer suitable for a given Work Area. The rates may be adjusted up or down. Employees will be given 1 month’s notice of any change to the rate of a loading or removal of composite pay. If composite pay arrangements are discontinued entirely in a Work Area, the Employees will receive any penalties in accordance with the provisions of this Agreement.
43.3.4 Employees may request a review of their composite pay loading if they believe that there is at least a difference of 2.5% between the composite pay loading for their Work Area and the penalties that would otherwise have been payable to the Work Area under this Agreement.
