The SBS Enterprise Agreement (Clause 49: Termination of Employment) provides the minimum period of notice for either an employee to resign employment from SBS, or notice of termination by SBS.
However, where an employee is covered by the Enterprise Agreement, but has a contract of employment that provides for a greater period of notice than the EA (that is, a longer notice period), this longer notice period agreed to in the contract of employment is applicable.
Non-Enterprise Agreement covered employees (Common Law) will have notice periods defined in their contracts of employment, and can be no less than the minimum entitlements provided for in the National Employment Standards.
