SBS can ask you to provide evidence to show that you took the leave because you were unable to work due to your own illness or injury or because you needed to provide care or support to an
immediate family or household member (because of an illness, injury or unexpected emergency affecting that person).
In most cases you will be required to provide a medical certificate for absences of 3 days or more. However, SBS reserves the right to require you to provide a medical certificate to verify
personal/carer’s leave for other absences, including but not limited to single day or part-day absences, for absences on a Monday or Friday and for absences before or after a public holiday or
rostered day off, including in circumstances where there is a concern regarding frequent or excessive absenteeism.
You may also be asked to provide further information if SBS determines that the information you have provided is not reasonable or sufficient to allow SBS to approve the leave. The evidence you
provide needs to convince a reasonable person that you were genuinely entitled to the personal (sick) or carer’s leave. If you are covered by the Enterprise Agreement, taking paid personal/carer’s leave is subject to you providing evidence when requested by SBS to substantiate the need to take leave for absences of 3 days or longer, or for frequent, short-term absences.
If your medical certificate expires whilst you are on personal/carer’s leave, you are required to provide updated medical certificates to cover ongoing period of absence.
In relation to unexpected emergencies or circumstances where it is not reasonably practicable for you to obtain a medical certificate, a statutory declaration may be sufficient in SBS’s discretion.
If you do not provide SBS with the requested evidence, you may not be entitled to be paid for your personal/carer’s leave and/or your leave may determined to be unauthorised.
